Because she knew that checking account was closed and she knew he was writing the checks. After they moved in I asked if they checked their checking account online and she said no. I asked what bank she had and I found the banks website and tried to register using their bank account. It wouldn't work. When it wouldn't work she started crying. Well after all this crap happened I know why it didn't work(closed account) and she was crying because she thought we would catch on and throw them out. I guess the fact is that I am too nice of a guy. That's all changed now. I have talked to a lawyer outside the county attorney and he said the same thing. We can go after them, but getting the money may cost more than what they owe and even if we win it's getting the money. I have read other forums about writing a check from a closed account and each one says that it is a criminal offense. Since it is a joint account I feel that both parties should be held liable. If not then they should have had separate accounts to avoid something like. Common sense if you ask me, which most of the country doesn't have.

i would walk away from this situation slowly and carefully
